Acharya Policy

Tinfo Edutech Private Limited ("Company"“We”, “Our” or “Us” and their connotations) operates a website called StarAcharya (URL: [insert the URL used by the Company]) (“Platform”) which is engaged in providing the service of connecting any professional teacher and, or, coach (“Acharya”) and the end users (“Learners”) who wish to avails the services of the Acharya.

Our Platform is primarily for the Acharyas who are enlisted on our Platform and the learners who wish to avail the training and, or, tutoring provided by the Acharyas. In the event that you are below the age of 18 years, you are advised to cease using the Platform immediately and shall not be permitted to use the Platform to provide the Services. The Acharyas hereinafter are referred to as You. The term "User(s)" for the purposes of this Acharya Policy shall be read as the Acharya and/or You.

This Acharya policy (‘‘Acharya Policy’’) is meant to help you understand terms of service of the Acharya, who wishes to enlist his/her services on the Platform. This Acharya Policy shall be read with the terms and conditions (available at (URL: [●])) (“Terms of Use”) and the privacy policy (available at (URL: [●])) (“Privacy Policy”). We provide the learners access to the list of Acharyas, services listed by the Acharyas on the Platform and relevant contact details of the Acharyas (hereinafter referred to as “Services”).

We reserve the right to amend and supplement to complete this Acharya Policy at any time. We encourage you to regularly review this Acharya Policy to get the latest updates to ensure that you know and utilize the features of the Platform in accordance with the terms of this Acharya Policy.

The Company hereby on-boards and grants You, a limited, non-exclusive, non-transferable right to use the Platform during the Term, solely for the provision of the Services and the operation of the Platform as specified under this Acharya Policy read with the Terms of Use.

The Acharya hereby represents that it has extensive experience in competing, teaching, educating, tutoring, training and coaching. The Acharya warrants that he/she has the required qualification and/or expertise required to provide his/her services as listed by the Acharya on the Platform. The Acharya acknowledges and understands that the Company is not liable to conduct a background check on the qualification and/or merit of the Acharya and assumes that the details provided by the Acharya are true and valid. In the event that the Acharya provides any kind of misrepresentation with respect to the Services and/or breaches the the Terms and/or is found guilty of any acts (or omission) which may cause any kind of claim to arise against the Company, the Acharya acknowledges and agrees to defend and hold harmless the Company, their officers, employees, agents, representatives, and contractors from and against any and all such third party claims and all losses, expenses, damages pertaining to the same.

In addition to complying with the Terms of Use, the Acharya’s role, terms and various responsibilities shall include, but not be limited to the following:

  1. The Acharya shall exclusively be acting in the capacity of an instructor, tutor and/or a coach and providing coaching/tutoring Services to the learners in accordance with the details as listed on the Platform by the Acharya.

  2. The Acharya warrants that he/she has obtained all the necessary legal/statutory qualifications required to enter into this Acharya Policy and all the information provided to the Company in connection with the Agreement and the Services provided by the Acharya is true to the best of his/her knowledge.

  3. The Acharya shall within his/her professional capacity provide training or tutoring services for which he has the expertise. The Acharya acknowledges that in the event he/she provides any kind services for which he/she doesn’t have the expertise, via the Platform, he/she shall be doing so at his/her sole discretion and the Company shall not bear any form of responsibility for such an act and shall be indemnified in accordance with Clause 5 of the Acharya Policy.

  4. The Acharya shall provide the Services with utmost diligence and care while maintaining the highest level of confidentiality.

  5. In case of any legal, statutory, contractual or any other form of incidental requirement, the Acharya undertakes to provide the Company with all the information and co-operation to the best of his/her abilities and not withhold any essential information.

The Company reserves the right to amend these terms, after providing the Acharya with prior notice.

The Company retains all rights (including copyrights, trademarks, patents, designs, logos, trade-dress, trade-secrets, know-how as well as any other intellectual property right) in relation to all information provided on or via this Platform (including but not limited to the curriculum taught, all texts, graphics, photos, illustrations, apps and logos). You shall not copy, download, publish, distribute or reproduce any of the information contained on this Platform or social media in any form without the prior written consent of the Company.

To the fullest extent of the law, the Acharya shall indemnify, defend and hold harmless the Company, their officers, employees, agents, representatives, and contractors from and against any and all third party claims, loss, costs, penalties, fines, damages, claims, expenses (including attorney’s fees) or liabilities arising out of, resulting from, or in connection with the performance  (or lack thereof) of the Services contemplated by this Acharya Policy including but not limited to loss and/or damage to any data and intellectual property infringement and the breach of the terms of this Acharya Policy read with the Terms of Use.

The term of this Acharya Policy shall commence on the date when the Acharya signs up of the Platform to provide his/her services and shall continue as long as the Acharya uses the Platform to provide his/her services.

Company may remove, restrict, cancel or suspend your access to and/or use of the Platform and any part of it, if Company considers (in the sole discretion of Company) that You have breached any of the Terms.

You may also terminate your agreement with Company by ceasing to access the Platform, deleting all copies of the Platform or part thereof within your control. Termination shall not affect any rights or remedies, which have accrued up to the time of termination.

Effect on termination:

  1. The Acharya shall be delisted from the Platform.

  2. To the extent as may be applicable, the Acharya shall promptly return and/or destroy, as directed by the Company, within 15 (fifteen) days from the date of termination, all items and copies containing or embodying confidential information without retaining any copies with himself/herself.

This Acharya Policy will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change Our Acharya Policy at any time and You should check this Acharya Policy periodically. Your continued use of the Service after we post any modifications to the Acharya Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Acharya Policy.

If We make any material changes to this Acharya Policy, We will notify You either through the email address You have provided to Us, or by placing a prominent notice on Our website.
